    The Zoning and Natural Resources Division is tasked with the provision of services and enforcement of matters related to the City Code.

    Zoning Ordinance

    The Zoning Ordinance regulates matters pertaining to uses permitted in specific zoning districts including: setbacks/yard regulations of principal and accessory structures (including residential and commercial uses), home occupations, livestock and poultry and sign regulations to name a few.

    The Zoning Ordinance does not regulate matters such as private deed restrictions, noise and other complaints similar in nature. Private matters are civil matters that must be handled with a private attorney.

    The Board of Zoning Appeals (BZA) consists of five (5) residents of the City of Lynchburg, appointed by the circuit court of the City of Lynchburg to 1.) hear and decide appeals from any order, requirement, decision or determination made by an administrative officer in the administration or enforcement of this ordinance and 2.) authorize upon appeal or original application in specific cases such variance or conditional use permit as defined in Section 35.1-13(a).

    The BZA meets as necessary on the 4th Tuesday of each month, or as called by the Chair.

    Erosion and Sediment Control Ordinance

    As a regional urban hub, the City of Lynchburg will focus and strive to attract new developments. In the process, the City of Lynchburg aims to conserve land, water, air and other natural resources, while also maximizing the quality of those resources.  The City's Erosion and Sediment Control Ordinance is one of the regulatory tools that has been adopted to protect the City's natural resources during the development process.

    Stormwater Management Program

    Beginning July 1, 2014, all localities will be REQUIRED by the Commonwealth of Virginia to enforce the Virginia Stormwater Management Act. Please review the City of Lynchburg Stormwater Ordinance for more details.

    As of July 1, 2014, new regulations are in effect regarding the Virginia Stormwater Management Program (VSMP). If you are a builder or land developer, you could be required to obtain a VSMP authority permit from DEQ for each new project prior to issuance of a local land disturbance permit. The VSMP Permit will:

    Add Time.  Permits will require additional time to work through the permitting process.Add Cost.  Permit fees will increase, as will the associated costs of planning, implementation and construction.  These items will need to be taken into project budget consideration.

    Add ResponsibilityResponsibility for stormwater management practices during and after construction will increase for the builder and the homeowner.
     

    Single Family Detached Residential Structures

    Single-family detached residential structures that either 1) disturb equal to or greater than one (1) acre of land or 2) disturb less than one (1) acre of land and that are part of a larger common plan of development or sale platted since July 1, 2004 (e.g. subdivision) require coverage under the General Permit for Discharges of Stormwater from Construction Activities. Operators of these land-disturbing activities are authorized to discharge under the general permit and are not required to submit a registration statement or the DEQ permit fee. Operators must also comply with the terms and conditions of the general permit including the preparation of a Stormwater Pollution Prevention Plan (SWPPP).

    Please follow these steps:  

    1. Download the Single-Family Stormwater Pollution Prevention Plan (SWPPP) template, revise to cover specifics of your project, and keep the SWPPP and documents listed below (permit, permit coverage letter, and complete Agreement in lieu of plan) on the site during land disturbance activity associated with construction of the house.     2. Print this agreement, fill it out and keep with the SWPP. Single-Family Agreement in Lieu of a Stormwater Management Plan (pdf)
    3. Print this permit, and keep with the SWPPP. General Permit for Discharges of Stormwater from Construction Activities (pdf)
    4. Print this letter, and keep with the SWPPP. Single-Family Detached Residential Structure Coverage Letter (pdf)
    5. Provide to the City of Lynchburg proof of stormwater permit coverage by the state by showing them these documents after you have completed and printed.  
    6. Obtain, fill out, and sign an Agreement in Lieu of an Erosion and Sediment Control Plan from the City which will become part of the SWPPP.  
    7. Apply for a land disturbance permit from the City.
